Subject: Education credits

For Sherry,
    You are eligible to claim the Hope Credit for tuition and fees for your daughter if she is enrolled in her first year of college and you are not filing 'Married Filing Separately' and she is claimed as your dependent on your tax return.  You should have received a Form 1098-T showing the education expenses that you can claim.
You must have paid these expenses in 2006 either out of your pocket or via a loan even if those payments applied to a future (or past) semester.  Tuition is self- explanatory but 'fees' applies only to those that 'are required for the student's enrollment or attendance at an eligible educational intstitution'.  In some instances, I have interpreted this to apply to the purchase of a laptop where it was 'required'
as a condition of enrollment but generally a computer would not be an eligible fee.
   The Hope Credit is 100% of your first $1100 of qualified expense paid and 50% of the next $1100 paid, for a total potential credit of $1650.  Your daughter must also be at least a 'half-time' student for at least one academic period in 2006.
   The Lifetime Learning Credit is a somewhat broader credit for anyone who pays qualified education expenses at an eligible educational institution.  This credit may be as much as $2000 (20% of qualified expenses up to $10,000) and applies to anyone who is past their first two years of college and/or is taking some course of study at a 'qualified educational institution'.
    It should be noted, however, that if you are one of those filthy rich couples whose 'adjusted gross income' is over $110,000, then you are not eligible for this credit.
    It should also be noted that you have the option to take the credit or an 'adjustment to income', depending on which will give you the most tax relief.  Don't ask me to explain that without seeing your specific situation.
    Oh yeah, your daughter must not have been convicted of a felony for possessing or distributing a controlled substance in order to take the Hope Credit.  If she has, then you have to take the Lifetime Learning Credit. (I didn't write the law!)
